Kinder Morgan Canada Inc. | Westridge Marine Terminal Upgrade and Expansion Project

June 8, 2017

Permit cancelled

This permit was previously issued to Kinder Morgan Canada Limited (Kinder Morgan) to upgrade and expand a portion of its existing Westridge Marine Terminal in Burnaby. The permit is no longer valid as a result of the Federal Court of Appeal decision in Tsleil-Waututh v. Canada (AG) 2018 FCA 153.

A new new National Energy Board’s Certificate of Public Convenience and Necessity (CPCN) was issued for the Trans Mountain Expansion Project on June 21, 2019, following a reinitiated Indigenous consultation process, reconsideration of project-related marine shipping and approval by the Governor in Council on June 18, 2019.

For information about the new project permit application that was required for the Westridge Marine Terminal Upgrade and Expansion Project, please visit the new project webpage.

Project history

On August 28, 2017 a project permit was approved for Kinder Morgan Canada (Kinder Morgan) to upgrade and expand a portion of its existing Westridge Marine Terminal. The terminal is partially located on federal lands and waters managed by the port authority at the foot of Bayview Drive in Burnaby, British Columbia. The project was approved subject to 57 permit conditions Kinder Morgan must meet to ensure the project is constructed safely, protects the environment, and in consideration of local communities does not result in significant adverse environmental effects.

Phasing and construction

Construction at the site began in the fall of 2017.

On August 30, 2018, the Federal Court of Appeal issued a Decision which canceled the Order-in Council, which had approved the project. At this time, all work ceased at the site.

Trans Mountain appealed to the National Energy Board (NEB) on September 10, 2018 (NEB Filing ID A93959) to undertake some additional work to ensure that the site was properly secure, safe and that risks to the environment, the public and workers would be minimized. Currently there are a number of construction elements which if left in their current half-finished state will have environmental impacts.

The NEB have provided permission to Trans Mountain to undertake work the following works starting on  September 20, 2018 for nine weeks.

  • Pile caps will be installed on any upright piles with open tops to minimize harm to wildlife (note deep water pile driving activity has been suspended);
  • Maintenance/installation of erosion control mitigation on the foreshore to protect exposed areas from erosion; and,
  • Sheet piles that are in varying stages of completion need to be driven to elevation and the cells backfilled in order to maintain the safety and integrity of the sheet pile structure.

For more information about the project, please visit Kinder Morgan’s website, or contact Kinder Morgan by email or by phone at 1.866.514.6700.

About the project

Kinder Morgan received a project permit to upgrade and expand the Westridge Marine Terminal in order to handle an increased volume of various crude oil types.

The system will be capable of serving up to 34 Aframax class vessels per month. The maximum size of vessels served at Westridge Marine Terminal will not change due to the project. Following the completion of the Project, operations at the Westridge Marine Terminal would occur on a 24-hours-per-day basis, seven-days-a-week.

The applicant has stated that construction is expected to begin in the fall of 2017 and be completed in the spring of 2020.

The terminal upgrade and expansion project is part of Kinder Morgan’s Trans Mountain Expansion Project, which is a Designated Project under the Canadian Environmental Assessment Act, 2012. For more information on the Trans Mountain Expansion Project environmental assessment process please visit the National Energy Board and British Columbia Environmental Assessment Office websites.
